When it comes to investigations, a poorly conducted investigation can be a plaintiff attorney's best friend.

When it comes down to it, at some point, most employers will need to conduct an investigation into employee acts or claims.

Investigations are a tool that in many situations, are not only required as a legal standard, but can also be the difference between winning or losing in litigation. Of course, ultimately, investigations should always be engaged with the intent to obtain facts and information to determine the truth.​ 
When it comes to the workplace, there are many different reasons that should trigger the need for an investigation. This includes:
  • Sexual and other harassment complaints
  • Discrimination complaints
  • Retaliation complaints
  • Workplace injuries
  • Theft
  • Fraud
  • Unethical Behavior
  • Drug and alcohol use 

Investigations are not simply about asking questions. They involve:
  • Identifying and interviewing all parties involved.
  • Asking the right, non-leading questions.
  • Being unbiased.
  • Understanding verbal and nonverbal language.
  • Documenting accurately.
  • Distinguishing facts from opinions.
  • Reviewing and assessing evidence and documents.
  • Reviewing and understanding related policies, procedures and laws.
  • Reporting the data.
  • ​Conducting and completing the investigation in a timely manner.
The qualifications and experience of the investigator matter. Failing to have these in place can quickly lead to the investigation not only being inadequate, but also being disregsarded in litigation.

It is critical that your investigator:
  • Is trained in interviewing and investigation techniques.
  • Has extensive experience conducting interviews and investigations.
  • Has expertise in the specific area that is being investigated (e.g., harassment, discrimination).

When possible, it is also recommended that a third-party be used to eliminate challenges of bias in the investigation.


Our investigations are led by Dr. Carlyle Rogers who has conducted over 350 investigations and interrogations including sexual and other harassment, discrimination, retaliation, workplace violence, theft, fraud, ethics violations, employment law violations, and workplace injuries. Dr. Rogers is also a certified Interrogator and member of the Association of Reid Trained Investigators.
